Appeals and Asylum

UKIVC have been regulated to give advice by the OISC to the highest level (Level 3). We are able to represent you in your asylum application and if need be, appeal.

Appeals:

If your application has been unsuccessful you may have the right to appeal the decision. You will be told either by your Immigration Adviser or in your decision letter if you have the right of appeal. If you applied in the UK you can appeal to the tribunal, make a reconsideration request or ask for an administrative review depending on your circumstance.

If you made your application from outside the UK you can appeal to the immigration and asylum tribunal if you have the legal right to appeal (you will be told in your decision letter). You may also be able to ask for an administrative review.

These are very delicate situations and expert advice is very much recommended. UKIVC is regulated to give advice at Level 3 allowing us to represent you at Tribunals.

Asylum:

You must apply for asylum if you want to stay in the UK as a refugee.

To be eligible you must have left your country and be unable to go back because you fear persecution.

If you want to be in the UK for another reason (eg to work, study or remain with family) you’ll need to apply for a visa.

You should apply when you arrive in the UK or as soon as you think it would be unsafe for you to return to your own country. Your application is more likely to be denied if you wait.

After you apply you’ll have a meeting with an immigration officer (known as a ‘screening’) and then an asylum interview with a caseworker.

You’ll usually get a decision on your application within 6 months.

You can get up to 2 years in prison or have to leave the UK if you give false information on your application.
